1. Who we are
GrowthDept is operated by ForgeAI Studio Ltd (company no. 17175307), registered office West Bromwich, United Kingdom ("we", "us", "our"). These Terms govern your access to and use of GrowthDept (the "Service"). By creating an account or using the Service you agree to these Terms.
2. The Service
GrowthDept is a sales and marketing service — your Growth Department — that plans, creates, schedules and analyses marketing for your business, with AI assistance. The Service generates drafts and recommendations and can, with your authorisation and through official integrations, publish content or send messages on your behalf. You remain responsible for what you choose to publish.
3. Your account
You must provide accurate information and keep your account secure. You are responsible for activity under your account. You must be at least 18 and authorised to act for the business you connect.
You must not use the Service to send spam, infringe others' rights, break platform rules, or generate unlawful, deceptive or harmful content.
4. Your content & approvals
You retain ownership of the business information, brand assets and content you provide. You grant us a licence to process it solely to provide the Service.
AI output is provided for your review. Where the Service can act outwardly (publishing, sending), it does so under your approval and our safety checks — but you are responsible for reviewing and approving outbound items before they go live.
5. Plans, fees & trials
New accounts start with a 14-day free trial. At the end of the trial, a paid subscription (described on our Pricing page) is required to continue using the Service; access to paid functionality ends if you do not subscribe. Fees are billed in advance and are exclusive of VAT where applicable. You can cancel at any time from Settings → Plan and keep access until the end of your current billing period.
6. Acceptable use
You agree not to misuse the Service, reverse-engineer it, resell it without authorisation, or use it to compete with us. We may suspend accounts that breach these Terms or put the Service, other users or third-party platforms at risk.
7. Third-party platforms
When you connect a third-party service (e.g. a social platform, analytics, payments or CRM), your use of that service is governed by its own terms. We access it only via official APIs and within the scopes you grant, and never by scraping.
8. Disclaimers & liability
The Service is provided "as is". AI output may contain errors; it is not professional, legal, financial or investment advice. To the extent permitted by law, our total liability is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential loss. Nothing limits liability that cannot be excluded by law.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for breach. On termination you can export your data for a reasonable period; thereafter we delete it in line with our Privacy Policy.
10. Changes & governing law
We may update these Terms; material changes will be notified. These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction.
